The following terms and conditions apply to all transactions processed by Mattressland ("the Conditions"). All
orders made are subject to the acceptance of these Conditions, and deemed to be accepted by you when placing
your order. These Conditions do not affect your statutory rights. These terms and conditions are subject to change
without notice and supersede all previous editions
1. PAYMENT
1.1 We will treat each order for goods as an offer by you to purchase the goods subject to these Conditions. You
are deemed to accept the Conditions when you place an order for goods with us. Our contract with you only begins
when we confirm acceptance of your offer to purchase goods from us. An order will not take place (and we will not
be deemed to have accepted your order) until we have validated and confirmed your payment. Any
communication, which you receive from us prior to validation, is not to be deemed as an acceptance of your order.
In the event of any pricing error occurring within our website, within a written or verbal quotation, or contained
within any fax or e-mail correspondence however received, all orders shall be deemed void.
1.2 We accept all major credit cards, cheques, wire transfer & BACS payments. In addition we accept official
purchase orders from Local Authorities, Government, Education, Financial, Healthcare, & other official corporate
bodies at our sole discretion.
1.3 All cheques, BACS, and wire payments must be cleared before any goods can be dispatched (please allow upto
7 working days for clearance). Purchase Orders should be faxed on 0871 242 5326 to reserve your goods.
However, no goods will be dispatched until we are in receipt of the original order. Our bank details for BACS and
Wire payments are available from our sales team on 0870 241 8414.
1.4 Many of the goods we sell are of a technical nature and whilst we endeavor to publish as much information as
is practical about the goods, the descriptions of the goods are as set out on the website. All drawings,
photographs, descriptive matter, colour, specifications and advertising on our website are for the sole purpose of
giving an approximate idea of the goods. They will not form part of the contract between us.
1.5 Ownership of the goods shall not pass to you until we have received payment in full (cleared funds).
1.6 Your order for goods is subject to stock availability. If we do not supply goods to you for any reason we will
inform you of the situation and will not charge you for those goods, and will refund any money already paid by you
for these goods. We are not liable for any financial loss incurred by you relating to interest payments, or loss of
earnings, or similar gains you would have received on monies paid to us in lieu of any unfulfilled order.
1.7 All prices quoted or displayed are in UK pounds sterling and shall be the price, inclusive of VAT & delivery, set
out on the website at the time your order is placed. A delivery charge may be added and clearly shown in the
orders section of the shopping cart before any online order can be placed, or as quoted by phone. We are entitled
to make adjustments to the price to take account of any increase in, or the imposition of any new taxes or duties. If
due to an error or omission the price published for the goods on our website is wrong we have the right to
terminate an order provided the goods have not been dispatched. We will try to ensure that all prices displayed on
our website are accurate, but should an error occur we would inform you of the correct price and give you an
opportunity to cancel the order.
1.8 Payment for goods must be made in accordance with our purchase procedure as set out on our website. All
orders are positively credit card sanctioned prior to dispatch. We can accept no responsibility if any details you
provide us with that are incorrect or if any order is held up as a result of incorrect or unsubstantiated details.
2. GUARANTEE
2.1 All new goods are sold with the benefit of a minimum 12-month manufacturer's guarantee. Full guarantee
details are available with your product, or from our customer services team. It is your responsibility to complete and
return the purchase registration form enclosed with the goods to the manufacturer.
2.2 If these goods are deemed tampered with in any way your guarantee will become void and you will become
responsible for the costs of replacement and return shipping. If no manufacturing fault is found you will be
responsible for the costs of replacement and return shipping. Wherever possible we will respond to your individual
circumstances. Mattressland.co.uk will not be liable for any transit damage that may occur on any product you
have returned to us for replacement. We strongly suggest that you make sure you have used sufficient packaging
to protect your product and insure against damage before returning any product for replacement. For advice on
how to pack your goods safely before return please contact our customer service team.
2.3 The guarantee does not cover, accidental damage, modifications to, failure(s) not due to manufacturing
defect(s), failure to comply with the original manufacturers' conditions of intended use, any accessories supplied.
Mattressland.co.uk cannot be held responsible for any costs arising from unauthorized repairs to equipment during
the guarantee period. Only Mattressland.co.uk or the product manufacturer or their authorised service agents can
carry out any guarantee work. Any unauthorized repairs or repair attempts will void the guarantee.
2.4 In relation to new goods the company will accept liability for defective goods only to the extent that the
company is entitled to make a claim under the manufacturer's guarantee and obtain from the manufacturer a
refund, credit, repair or replacement of the defective goods.
3. DELIVERY
3.1 Delivery of the goods must be signed for. The address will be that registered with your payment card issuer,
unless you request otherwise and we agree to such a request (at our sole discretion).
3.2 We will endeavor to deliver your goods if in stock within 1 - 10 working days (with the exception of weekends &
public holidays). If we are unable to deliver the goods for any reason you will be notified and will not be obliged to
pay for the goods. However, we shall not be liable for any loss, which may be suffered by you caused by any delay
of delivery unless caused by our negligence. If delivery of the goods is delayed by more than 30 days, you shall be
entitled to contact us and cancel the order. Any monies paid in respect of goods, which are not delivered, will be
refunded.
3.3 If goods arrive in a damaged condition you must inform us within 24 hours. We shall arrange collection of the
goods (other than used goods) and will either replace the goods at no extra charge, or refund any monies paid by
you for the goods (excluding Delivery Costs or Charges).
3.4 Mattressland.co.uk must be notified within 24hours if any part of your order is missing. All claims will become
void after this period.
3.5 We will deliver to business addresses at your request but stress that if instructed to do so, the card used in the
transaction must be officially registered to that address. Also you are agreeing that anyone situated at your
business address has your written authority to accept goods on your behalf. We will accept no responsibility for
goods once they have been delivered to and signed for at the requested address.
3.6 Delivery Charges. All our carriage charges are displayed in the shopping basket, or on the page called
delivery, or via our sales team and are based on UK mainland only. Non-UK mainland may incur a surcharge
please contact our sales team for a quotation.
4. REFUNDS, RETURNS & CANCELLATIONS.

4.1 You have a statutory right under the Consumer Protection (Distance Selling) Regulations 2000 to cancel this agreement within 7 working days of the Products being delivered. We will provide a full refund (less all associated delivery charges see paragraph 4.6) if the product you have selected is found to be unsuitable within 7 working days following delivery, providing the product is returned in it's original box, in "as new" condition, unmarked and all polyurethane packaging still factory sealed.
4.3
All cancelled orders and returned goods 'other than faulty goods' are subject to a mandatory 15% cancellation/ re-stocking fee.
4.4
Please ensure that you keep the original packaging in which the Products are delivered in case you wish to make a return. You must ensure that any products you may wish to return are adequately packaged to protect them from being soiled or damaged whilst being returned to us. If any items are not packaged adequately our couriers will refuse to uplift the goods. Optionally, when you call to arrange collection we can provide you with suitable packaging. This can be ordered from us at a cost of £10 + postage & packaging charged at £9.99. Total amount payable £19.99.
4.5 Please ensure that all Products packaged for return are clearly labeled with your name, postal address and
order number. If you try to return Products to us in a soiled or damaged state, we may refuse to collect or take
away those Products. If (on return to our premises) we find that Products collected from you are in a soiled or
damaged state, we reserve the right to re-deliver those Products to you and/or to require payment in full from you
for those Products and you hereby authorize us to collect all sums required for us to effect payment in full using the
debit/credit card details provided to us at the time of placing your order.
4.6 All return carriage costs of will be borne by you the customer. If you contact us during the 7 day cooling off period to cancel the agreement and request that we collect the Products from you, we will refund all payments made by you for the returned Products at that date, less our carriage costs which are inclusive of VAT. Carriage Costs per item: Mattresses £70.00 Divan Sets £120.00. Other Miscellaneous Items £100.00
4.7.1 We regret that we cannot accept returns of the following: Divan bases, pillows, mattresses and products that
have been made to a bespoke size or personalised. The above products will be exempt from the statutory 7 day
cooling of period where the products have been unsealed, and your right to cancel will have ended for reasons of
health and hygiene as the product will be deemed to have been used. We recommend that you make full use of
our sales team for advice prior to purchase. We adhere to the Consumer Protection (Distance Selling) Regulations
2000 No.2334.
4.7.2
Vacuum Sealed, Roll Packed Mattresses: By accepting our terms and conditions you authorise this product to be exempt from the statutory 7 day cooling of period where the products have been unsealed, and your right to cancel will have ended for reasons of health and hygiene as the product will be deemed to have been used. We recommend that you make full use of our sales team for advice prior to purchase. We adhere to the Consumer Protection (Distance Selling) Regulations 2000 No.2334.
5. MISCELLANEOUS
5.1 We shall not be liable to you for any failure or delay in performance of our contract. If it is due to an event
beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest
and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing
such obligations.
5.2 These terms are subject to English law and the parties agree to submit to the exclusive jurisdiction of the
English Courts.
1. 30 NIGHT TRIAL
1.1 This 30-night trial agreement is entered into by Mattressland (referred to as "we", "us", "our" or "BackCare
Initiative") and you, the Customer (referred to as "you" or "your") placing the order to receive our products (the
"Products", as defined on our website) on a 30-night trial basis. By taking our Products on the 30-night "no
commitment" trial basis, you accept these terms and conditions.
1.2 The Products are supplied to you on the WEBSITE TERMS AND CONDITIONS as set out on the website. The
terms of this 30-night trial are in addition to those terms.
1.3 Only one mattress can be trialed per household. If you order more products than stated above, our Direct
Sales Team will be in contact with you to discuss your order.
1.4 The 30-night trial will commence from the date on which the Products are delivered to you and will end at
midnight on the 30th day after that date.
1.5 Please ensure that the Products are in satisfactory condition when you receive them. If the Products are soiled
or damaged on delivery to you, you must tell us as soon as possible and in any event within 24 hours of delivery,
so that we can arrange for collection and (if requested) exchange of any Products.
1.6 If you wish to exchange any products during the 30-night trial, the new products will not be eligible for the 30-
night trial.
2. RETURN TERMS AND CONDITIONS Please contact customerservices@mattressland.co.uk
2.1 You have a statutory right under the Consumer Protection (Distance Selling) Regulations 2000 to cancel this
agreement within 7 working days of the Products being delivered. The 30-night trial is offered by Mattressland over
and above that statutory right.
2.2 In the unlikely event that you are dissatisfied with the Products in any way and wish to cancel the agreement
and return the Products to us, you must contact a member of our customer service team within the 30-night trial
period on 0870 241 8414. We will then arrange for the Products to be collected from you.
2.3
Returns carriage cost of £19.95 will be borne by you the sender.
2.4 We will only collect our Products from you if the Products are unsoiled and undamaged. You must ensure that
Products which you wish to return are adequately packaged to protect them from being soiled or damaged whilst
being returned to us. Please ensure that you keep the original packaging in which the Products are delivered in
case you wish to make a return. Alternatively, we can provide you with suitable packaging.
This can be ordered from us at a cost of £10 + postage & packaging charged at £9.99. Total amount payable £19.99.
2.5 Please ensure that all Products packaged for return are clearly labeled with your name, postal address and
order number. If you try to return Products to us in a soiled or damaged state, we may refuse to collect or take
away those Products. If (on return to our premises) we find that Products collected from you are in a soiled or
damaged state, we reserve the right to re-deliver those Products to you and/or to require payment in full from you

debit/credit card details provided to us at the time of placing your 30-night trial order.
3. PAYMENT TERMS
3.1 Full payment of the products including a delivery charge is payable prior to delivery of any Products to you. We
will collect this payment from you when you place your order through the website with the 30-night trial.
3.2 You can pay in full by the following methods: Visa / MasterCard / Switch/ Delta / American Express / Electron /
Solo. Payment is due in full at the start of the 30-night trial period. We will not deliver the Products to you until we
have received and cleared your payment. If you decide to cancel the agreement during the 30-night trial period, we
will issue a refund to you. Please see the section headed "Refunds on cancellation during the 30-night trial period"
for full details.
4. VARIATION OF TERMS
4.1 No variation to these terms and conditions shall be binding on Mattressland unless we have confirmed our
acceptance of that variation in writing to you.
5. REFUNDS ON CANCELLATION DURING THE 30-NIGHT TRIAL PERIOD
5.1 If you contact us during the 30-night trial period to cancel the agreement and request that we collect the Products from you, we will refund all payments made by you for the returned Products at that date, less our returns carriage costs, which is £39.00. For full details of our return terms, please see the heading "Return Terms and Conditions" above.
6. IMPORTANT NOTICE
6.1 If you fail to contact us to cancel your trial of the Products and arrange for our Products to be collected from
you before the end of the trial period, we will be entitled to assume that you have accepted the Products
unconditionally. You agree, if we have not heard from you at the end of the 30-night trial period, that we may treat
your silence as unconditional acceptance of the Products being trialed.
